Public Hearing: California law (see Government Code language below) requires that items to be negotiated be “sunshined,” or brought to light for the public, and that the Board of Education provides an opportunity for public comment before approving the opening of such negotiations.
Per Board Policy 4243.1, "After the public has had an opportunity to provide input, the Board shall adopt its initial proposal at a public meeting."
The Morgan Hill Federation of Teachers sunshined their reopeners at the last regular meeting of the Board. Attached are the reopeners of the Morgan Hill Unified School District.
Government Code Section 3547.
(a) All initial proposals of exclusive representatives and of public school employers, which relate to matters within the scope of representation, shall be presented at a public meeting of the public school employer and thereafter shall be public records.
(b) Meeting and negotiating shall not take place on any proposal until a reasonable time has elapsed after the submission of the proposal to enable the public to become informed and the public has the opportunity to express itself regarding the proposal at a meeting of the public school employer.
(c) After the public has had the opportunity to express itself, the public school employer shall, at a meeting which is open to the public, adopt its initial proposal.
(d) New subjects of meeting and negotiating arising after the presentation of initial proposals shall be made public within 24 hours. If a vote is taken on such subject by the public school employer, the vote thereon by each member voting shall also be made public within 24 hours.
(e) The board may adopt regulations for the purpose of implementing this section, which are consistent with the intent of the section; namely that the public be informed of the issues that are being negotiated upon and have full opportunity to express their views on the issues to the public school employer, and to know of the positions of their elected representatives.
Government Code Section 3547.5.
(a) Before a public school employer enters into a written agreement with an exclusive representative covering matters within the scope of representation, the major provisions of the agreement, including, but not limited to, the costs that would be incurred by the public school employer under the agreement for the current and subsequent fiscal years, shall be disclosed at a public meeting of the public school employer in a format established for this purpose by the Superintendent of Public Instruction.
(b) The superintendent of the school district and chief business official shall certify in writing that the costs incurred by the school district under the agreement can be met by the district during the term of the agreement. This certification shall be prepared in a format similar to that of the reports required pursuant to Sections 42130 and 42131 of the Education Code and shall itemize any budget revision necessary to meet the costs of the agreement in each year of its term.
Following the public hearing, it is recommended that the Board of Education accept the attached reopeners for negotiations with the Morgan Hill Federation of Teachers from the Morgan Hill Unified School District. |

2203015 District Reopeners

In accordance with Education Code 42130, a school district is required to submit twice during the fiscal year a financial report certifying the district’s ability to meet its financial obligations. These reports examine the district’s enrollment, spending pattern, fund balance, and reserve for economic uncertainties.
There are several purposes for these reports:
- To provide a review of the District’s financial condition at periodic intervals during the fiscal year
- To provide a status report to the Board of Education and the public of the financial condition of the District
- To determine necessary budget revisions as a result of current or projected financial information. The interim reflects adopted, revised and projected budgets. The second interim report reflects financial and budgetary status as of January 31, 2022.
Attached are the State prescribed budget forms, a narrative explaining the changes in all funds, and a spreadsheet summarizing the budgeted amounts. |

The themed Board meeting titled “College Partnerships” will provide a summary of our existing district college partnerships and will highlight the work underway to enhance connections with local higher education partners. The presentation will include an overview of the draft K-12 Counseling Plan, equitable master schedules, Naviance, Cal-SOAP, and Community College dual enrollment opportunities for students. |

The Morgan Hill Unified Board of Education wish to engage with district community members outside of school board meetings. These informal Trustee Chats are intended for community members within the school district boundaries. Trustee Sullivan and Dr. García will present a plan that includes a program overview with embedded strict adherence to the Brown Act, timelines, rotations, translation, and communication, among others. |
