The District contracts with consultants or independent contractors who can provide valuable and necessary specialized services not normally required on a continuing basis. Pursuant to Education Code 17604 and Board Policy 3312(a), the Superintendent or designee (employees identified in Bd.Ed. 2021-22 Reso. No. 003) has the authority to enter into contracts with a value up to $100,000 on behalf of the District. These contracts must be subsequently ratified by the Board.

On November 6, 2012, voters residing within the Morgan Hill Unified School District passed Measure G. Measure G is a $198.25 million bond measure that authorizes funding for needed repairs, upgrades, and new construction projects to the District’s schools. Since the bond was passed in accordance with the provisions of Proposition 39, state law requires that the Morgan Hill Unified School District appoint a Citizens’ Oversight Committee (Committee) to oversee the bond measure. In accordance with Education Code Section 15278(b), the Committee responsibilities are:
- Inform the public concerning the District’s expenditure of Measure G bond proceeds;
- Review expenditure reports produced by the District to ensure that Measure G bond proceeds were expended only for the purposes set forth in Measure G; and
- Present to the Board of Education in public session, an annual written report outlining their activities and conclusions regarding the expenditure of Measure G bond proceeds.
The following Committee positions are currently vacant: member active in a business organization representing the business community located in the District, member active in a bona-fide taxpayers association, and senior citizen group. The vacant Committee positions were advertised in the local newspaper, the District’s website and social media account.
One application was received for the role of member active in a business organization representing the business community located in the District. After reviewing the application, Staff recommends that Matthew Vargas be appointed for the term of February 2022 – February 2024. |

School climate has a lasting effect on student’s ability to learn and student’s safety and preparation is one of the first and most important priorities at Morgan Hill Unified School District.
The District has a goal to increase student engagement, connection to school and community, and inspire productive persistence in ALL students to graduate college and career ready. (LCAP Goal #3. Student Engagement and School Climate)
California Education Code Section 32286 requires each school site to review and update its school safety plan by March 1 of each year. These plans must have policies that deal with crime, safety, child abuse reporting procedures, disaster preparedness, emergency shelters, discrimination, harassment, intimidation, bullying, hate crimes, toxic substances, and more.
The Safe School Plan updates are informed by a review of the following data: Campus Climate Surveys, school crime data, suspensions/expulsions/counseling referrals, law enforcement reports and changes to employee rosters. The Safe School Plans were updated collaboratively with district administration, site administration, certificated staff, classified staff, School Site Councils, community members, parents, students and law enforcement agencies in the community. Additionally, the CDE document School Safety Elements and Resources helped schools identify ways to improve their school climate and safety. We have added a section to address the needs around COVID-19 that was developed by the district safety committee as well as site based safety teams.
The District’s Safe School Plans used the School Safety Plan Self-Monitoring Tool provided by the California Department of Education to ensure alignment with items that are necessary to comply with the law. |

The District is recommending the approval of a new classified position of Lead Farmer. Under general supervision of the Director of Student Nutrition, this new position will perform technical tasks and duties within the Freight Farm and with other farming initiatives related to planting, growing, and harvesting of hydroponic and other crops for the purpose of providing hyper-local food sources for the Student Nutrition program. With the addition of any new classified position, Human Resources develops the job description in collaboration with the hiring Director. In consultation with MHCEA, a salary range is recommended to the Personnel Commission, considering similar responsibilities within other existing job classifications. At the January 19, 2022 meeting, the Personnel Commission, approved range 48 for this new position. Once the job description is approved by the Board of Education, Human Resources will begin the recruiting and hiring process as identified by the Merit System.
Staff recommends that the Board of Education approve the attached job description for Lead Farmer. |

Attached is the tie-breaking criteria agreed upon between the Morgan Hill Federation of Teachers and the District and outlined in Article 7 of the collective bargaining agreement. In order to meet the requirements of Education Code 44955, "As between employees who first rendered paid service to the district on the same date, the governing board shall determine the order of termination solely on the basis of needs of the district and the students thereof." To annually comply with Education Code 44955, the Governing Board of the Morgan Hill Unified School District acts upon the Resolution to Adopt Criteria for Determining Order of Seniority for Those Employees with the Same Date of First Paid Service in a Probationary Position in the event of a layoff in Particular Kinds of Services (PKS) where affected employees may have the same date of hire. |

On September 15, 2017, the Board of Education approved the Series B preliminary project list. The $80 million in proceeds from Series B were broken into six major categories:- Britton Middle School reconstruction
- Nordstrom Elementary portable replacement and administration modernization
- Jackson Academy of Math and Music new classroom and modernization of multi-purpose room
- Technology infrastructure and instructional technology replacement
- Construction management
- Safety and Security
Of the $80 million series bond funds, $69.3 million has been spent for a total of 83% of Series B as of November 30, 2021. Staff will be available to respond to any questions related to the attached report. |

Following each federal census, the Board must approve adjustments of trustee area boundaries, if necessary, to make sure the population in each trustee area is as nearly as equal as practicable, amongst other considerations (Education Code section 5019). After review of the most recent census data, the District’s demographer (SchoolWorks, Inc.) has determined that the current trustee area maps need to be revised since the population is no longer balanced. At the December 14, 2021 meeting SchoolWorks, Inc. provided draft adjusted map options for discussion and input. A Public Hearing was also conducted to give an opportunity to the community to provide feedback. Based on the feedback provided, a new Map D was drawn to create more compact and contiguous geographic trustee areas. At the January 11, 2022 meeting a second Public Hearing was conducted. The Board's discussions included school representation balance, community feel, and cities of Morgan Hill and San Jose Council remapping. SchoolWorks, Inc. has created Maps E, F and G to incorporate the Board's requests. Ken Reynolds of SchoolWorks, Inc. will present the new trustee area boundaries map options. A summary of Maps A-F is below: Plan A – Adjustments to current boundaries – Peak Deviation = 5.77% Plan B – Adjustments to current boundaries – Peak Deviation = 5.77% Plan C – Adjustments to current boundaries – Peak Deviation = 7.74% Plan D – Created a new map without using current boundaries – Peak Deviation = 8.81% Plan E – Similar to Plan D but with a school in each trustee area – Peak Deviation = 7.75% Plan F – Similar to Plan D but creates both a San Jose north area and a San Martin south area – Peak Deviation = 2.86% Plan G – Similar to Plan F but focuses on cleaner compact boundaries – Peak Deviation = 9.07% |

Every ten years, after the U.S. Census data is released, school districts are required to evaluate whether their current trustee areas have approximately equal populations using the new census data. The variation in total population among trustee areas cannot exceed 10%. If the variation is less than 10%, no changes are needed. If the variation exceeds 10%, trustee area boundaries need to be adjusted. This process is referred to as redistricting. Trustee areas must be made as equal in population as possible and practicable to provide equal access to political representation. The District has hired professional demographers, SchoolWorks, Inc., to draft and revise maps for consideration by the public and the Board of Education. The draft “revised maps” will ensure appropriate population balance and will incorporate feedback previously received by the Board and the community. This is the third and final Public Hearing conducted so that members of the public can provide input on draft revised maps prior to the Board taking action this evening. After adoption of a new map, it will be sent to the County Superintendent of Schools and the County Registrar of Voters. The County Registrar of Voters will then adjust precinct boundaries before the filing deadline for the November 2022 trustee election and the new map will be used for the first time in the November 2022 election. |

Board action to adopt a map this evening will provide ample time to ensure approval, compliance, and submission to County well in advance of the February 28, 2022 deadline. The new trustee area maps will be put into effect for the November 2022 Board elections. |
